Archer Brogan is acutely aware of the rapidly unfolding efforts of our community to cope with and control COVID-19. We are taking every precaution to minimize any possible risk in our offices. Having said that, our offices in Hamilton and Jamesburg REMAIN OPEN DAILY for in-person appointments, although most of our staff will be working from home where possible. The firm’s Bridgewater and Moorestown offices are available by appointment. The firm is also offering phone and video consultation via Zoom to anyone who might prefer that right now.
Archer Brogan remains the State’s premier elder law crisis management firm, and we stand ready, willing, and able to assist with your elder law and estate planning concerns in this or any other time.
is a central Jersey law firm focusing exclusively on the needs of those who care for seniors, veterans, and people with disabilities.
Medicaid Planning and Applications
Medicaid is designed to ease the burden of paying for long-term care, but it can be very complicated to navigate the system and care is enormously costly if you do not succeed. The State has implemented regulations to govern eligibility for these programs but their interpretation often varies by county and even by caseworker.
Archer Brogan has experience filing a large number of applications annually in many New Jersey counties, so we know what the caseworker is going to ask for even before they do. We can spot and anticipate issues before we file an application, so we give a client as much as clarity as possible, and process applications more quickly.
Care and Crisis Management
What sets Archer Brogan apart from typical elder law firms in the region is its commitment not only to legal documents and complex planning when appropriate, but also to the practical and people-centered needs of its caregiver clients. The firm’s Director of Senior Living Resources, Tom Callahan, guides families to find the best senior housing options for their loved ones’ individual circumstances and challenges. He is also called upon to defuse high-conflict situations where caregivers and concerned family are unable to address issues themselves. With assistance from Tom and the firm’s legal personnel, families can work together toward a solution that benefits their loved ones while saving both the stress and expense of litigation, and the structure and rigor of a social work environment.
The staff of Archer Brogan provides a full range of services and supports to caregivers through central
and southern New Jersey.
Medicaid Asset Planning
Medicaid Asset Planning
New Jersey is a notoriously tough state in which to do Medicaid planning; however, there are a number of ways that aggressive planning can yield enormous savings for a family. The key is to start early.
Veterans with low income and high medical expenses may be entitled to over $2,000 of monthly tax-free cash payments from the VA through the Aid and Attendance program. The program has specific eligibility requirements.
Guardianships and Special Needs
A guardianship proceeding protects vulnerable adults and their caregivers. Families whose loved ones have special needs require specific guidance and legal planning to preserve assets and receive government benefits.
Any person over 18 should consider having a Will, a Durable General Power of Attorney, and a Healthcare Proxy (or similar medical document). The documents can eliminate stressful legal emergencies in the future.
Estate Administration & Probate
Estate Administration & Probate
Probate or estate administration in New Jersey grant authority to act on behalf of a deceased person. The process can be easy or very difficult, but it can be hard to tell which without expert guidance.
